Clients must be aware of our Terms and Conditions as laid out here and accept the risks associated with these activities. Scandinavian Boot Camp strongly recommends that Clients take out personal accident, personal liability, holiday and cancellation insurance before attending Camp.
These Terms and Conditions are modified from time to time so please ensure you are aware of the recent Terms and Conditions at the time of signing a contract with Scandinavian Boot Camp.
Scandinavian Boot Camp AB (hereafter referred to as Scandinavian Boot Camp) accepts bookings subject to the following Terms and Conditions:
Interpretation and Definitions
1.1 The following expressions shall have the following meanings:
‘Balance’ is the remaining cost of the booking once the deposit has been paid; the balance is to be paid in full at least 4 weeks before the start of the Boot Camp to which the cost applies.
‘Scandinavian Boot Camp’ means Scandinavian Boot Camp.
‘Booking Form’ is the booking form produced by Scandinavian Boot Camp, to be completed by the Client upon making a booking with Scandinavian Boot Camp.
‘Client’ is the person or persons listed on the booking form and with whom Scandinavian Boot Camp agrees a contract for the provision of services in the form of a Boot Camp.
‘Contract’ is the agreement between the Client and Scandinavian Boot Camp under which services are to be provided by Scandinavian Boot Camp to the Client.
‘Course Director’ means the representative of Scandinavian Boot Camp responsible for the delivery of the Boot Camp and other agreed services under the contract.
‘Deposit’ means the deposit as indicated on the site, being the agreed percentage of the total agreed cost of the booking; paid by the Client upon making a booking to secure a place on Boot Camp.
‘Force Majeur’ means any situation or event beyond the control of Scandinavian Boot Camp including, but not limited to, an act of God, terrorist activity or war, industrial action, civil strife, rioting or other law-breaking by whomsoever, disaster, accident, break-down, fire, breach of contract by suppliers or contractors of Scandinavian Boot Camp, compliance with any legal rule or governmental order, adverse weather or road conditions, travel disruption or changes in public transport schedules, quarantine, epidemics and government action.
‘Major Change’ means a change of date of, location of, or more than 80% of services offered by a particular Boot Camp run by Scandinavian Boot Camp.
‘Recording’ means photographs or other recordings of the Client during the provision of the services.
‘Services’ refers to those services provided by Scandinavian Boot Camp to the Client during the Boot Camp booked by the Client or in connection to the Boot Camp booked by the Client and may include, but are not limited to, training sessions, advice, documentation and other activities provided by Scandinavian Boot Camp for the benefit of the Client.
1.2 Any reference to the singular in these Terms and Conditions includes the plural and vice versa. Any reference to male includes female and vice versa.
1.3 Headings used in these Terms and Conditions are for the readers’ convenience and shall not affect their interpretation.
1.4 Failure by either party to enforce at any time one or more of these Terms and Conditions shall not be considered a waiver of them or of the right subsequently to enforce any or all of the Terms and Conditions of this agreement.
2.1 A contract for the provision of services by Scandinavian Boot Camp is made between Scandinavian Boot Camp and the Client when the balance is paid and Scandinavian Body Boot Camp issues written confirmation of the booking.
2.2 By entering into a contract with Scandinavian Boot Camp, the Client is deemed to have read and accepted these Terms and Conditions, which may only be altered with the written agreement of Scandinavian Boot Camp.
2.3 The contract between Scandinavian Boot Camp and the Client contains the entire agreement between the parties concerning its subject matter; no verbal representations made by Scandinavian Boot Camp can be relied upon by the Client.
3.1 A booking is made when the Client completes a booking form and associated additional forms and pays the required deposit of the total booking fee as indicated on the site. Scandinavian Boot Camp reserves the right to decline any booking at its sole discretion. All bookings are provisional until the deposit as indicated on the site is received in cleared funds in Scandinavian Boot Camp’s bank account.
3.2 Signing the booking form signifies the Client’s acceptance of the Course Director’s authority to make decisions affecting the group or individuals on Boot Camp.
Payment and Discounts
4.1 A deposit of the agreed percentage of the total agreed cost of the booking as indicated on the site is payable at the time of making a booking to secure the Client’s place on Boot Camp; the balance is payable not less than 8 weeks before the start of the Camp on which the Client is booked. In the event that the balance is not paid on time, Scandinavian Boot Camp has the discretion to treat the booking as cancelled by the Client and re-sell the place. Bookings made within 4 weeks of the start of the course require a deposit of the agreed percentage of the total agreed cost of the booking as indicated on the site with the balance to be paid within 1 week of making the booking. For bookings made within 1 week of the start of the course, the total agreed cost of the booking must be paid immediately.
4.2 Scandinavian Boot Camp accepts payment via bank transfer or the PayPal Payment Gateway. The PayPal Payment Gateway can accept payment from a PayPal Account, or from the following credit and debit cards: Visa, Visa Debit, MasterCard, Maestro and American Express. You do not need to have a PayPal Account to pay by credit/debit card via the PayPal Payment Gateway.
4.3 Scandinavian Boot Camp may, at its discretion, offer Clients a discount on future bookings with Scandinavian Boot Camp. Where Scandinavian Boot Camp opts to so offer a discount the discount is applicable only to a booking made by that Client for that Client and not for other Clients who may book at the same time or as part of a group that contains the former Client. Discounts are strictly non-transferable and Scandinavian Boot Camp reserves the right to withdraw a discount at any time and without giving a reason and in such situation no compensation will be payable to Clients.
4.4 Prices are quoted in Great British Pounds Sterling (“GBP”) and converted at the PayPal Payment Gateway to your local currency. Non-GBP prices are therefore approximate as exchange rates will vary. Prices quoted do not include any additional fees outside of our control, such as credit card exchange charges. Rates are updated hourly and are provided by openexchangerates.org.
4.5 All transactions will be processed in Great British Pounds Sterling. In the case of a refund, due to exchange rate fluctuations, you may not receive the exact same amount. We are not responsible for refunding any additional exchange fees such as those charged by credit card companies.
5.1 It is the Client’s responsibility to inform Scandinavian Boot Camp in writing of any health issues that may make them unsuitable to participate in all or some of the sessions and activities provided on Boot Camp. If Scandinavian Boot Camp believes a Client’s health or safety is at risk, or that a Client has failed to disclose any relevant health information in accordance with these conditions, Scandinavian Boot Camp has absolute discretion to withdraw the Client from the session, activity or entire Boot Camp without refund and/or may terminate the Contract without refund.
5.2 Participating in Scandinavian Boot Camp involves vigorous physical activity. Scandinavian Boot Camp recommends that all Clients speak to their GP about this ahead of attending in order to establish their suitability for Scandinavian Boot Camp. Scandinavian Boot Camp assumes no responsibility for persons who undertake physical activity.
5.3 Clients shall abide by any rules or instructions laid down by Scandinavian Boot Camp in regards to safety or proper practice. Scandinavian Boot Camp reserves the right to expel without refund a Client from Boot Camp for taking part in any illegal activity during the course of Boot Camp or any conduct which may offend or cause danger or damage to any person or property. Scandinavian Boot Camp will have no liability to the Client in such circumstances.
5.4 The Client shall not at any time during or after taking part on a Boot Camp use information gained from Scandinavian Boot Camp for commercial purposes or financial gain, nor divulge the personal information of other Clients at Scandinavian Boot Camp.
5.5 It is the Client’s responsibility to arrange and pay for travel to and from Boot Camp. The Client is also responsible for his/her own medical needs and personal footwear, equipment and clothing.
Variations and Amendments
6.1 Information published by Scandinavian Boot Camp is for general illustrative purposes only. Scandinavian Boot Camp reserves the right to alter the precise content of its Boot Camp itineraries at any time without notice to the Client, provided the Boot Camps remain generally of the type described. The Course Director will review and may alter the programme as the Boot Camp progresses in response to the changing influence of factors such as weather conditions, and the level of fitness and aptitude of Clients.
6.2 Scandinavian Boot Camp reserves the right to change any price or other particulars of the Services before the Client makes a booking and pays a deposit.
6.3 If there is a Major Change to a confirmed booking Scandinavian Boot Camp will inform the Client as soon as is reasonably practical and offer the Client the choice of accepting the change, receiving a full refund or transferring to another available Scandinavian Boot Camp course (with pro-rata refund/price increase as appropriate). Paying the Client compensation will only be considered if the Major Change was caused by anything other than Force Majeure or low bookings, and will depend inter alia on the nature of the change and length of notice received by the Client.
6.4 If there is any change other than a Major Change, Scandinavian Boot Camp is not obliged to inform Clients in advance (though will do so where practicable) nor is it obliged to pay compensation. If Scandinavian Boot Camp is unable to provide a major proportion of the services booked by the Client with Scandinavian Boot Camp, it will make every effort to arrange alternative arrangements for the Client and where appropriate will refund the Client for services not received.
6.5 If the Client wishes to make major changes to the agreed programme, additional costs may be applied at Scandinavian Boot Camp’s discretion.
Representations by Scandinavian Boot Camp
7.1 Scandinavian Boot Camp gives examples on its website and in its literature of typical results that can be achieved by Clients attending boot camp. These are examples only and Scandinavian Boot Camp makes no guarantee of results; all Clients are different and will achieve varying results.
8.1 If the Client elects not to participate in any part of the sessions or activities provided by Scandinavian Boot Camp, Scandinavian Boot Camp has no obligation to provide an alternative, and the Client will not be entitled to a refund. The Client cannot expect to maximise their results if they choose not to participate fully in the itinerary created for them by the Course Director.
8.2 Should a Client injure himself during the course of a boot camp and require to go home because of the injury, Scandinavian Boot Camp have no liability for additional costs incurred as a result of this and in such circumstances will not offer Clients a refund.
9.1 A Client wishing to cancel their contract with Scandinavian Boot Camp should advise Scandinavian Boot Camp of this in writing as soon as possible and will be subject to the following cancellation charges based on the number of days before the commencement of boot camp said notice of cancellation was given to Scandinavian Boot Camp:
Dates of cancellations. Cancellation charge if less than 8 weeks 100% of the fee. Less than 12 weeks, 75% of the fee. Less than 16 weeks, 50% of the fee. More than 16 weeks, 30% of the fee.
9.2 Participants who don’t show up to boot camp and who do not inform Scandinavian Boot Camp will forfeit the full cost of their booking.
9.3 Scandinavian Boot Camp endeavours never to cancel a confirmed booking but reserves the right to do so. If Scandinavian Boot Camp cancels a booking prior to the commencement of the course Scandinavian Boot Camp will inform the Client as soon as is reasonably practical and offer them the choice of a full refund or transferring to another available Scandinavian Boot Camp course (with pro-rata refund/price increases as appropriate).
9.4 Both parties shall be released from their respective obligations in the event of national emergency, war, prohibitive governmental regulation, or any other cause beyond the reasonable control of the parties, or if either of them renders the performance of the agreement practically impossible.
10.1 The Client is unable to assign or transfer their Contract with Scandinavian Boot Camp to a third party without the prior written consent of Scandinavian Boot Camp. The Client should give written notice, providing Scandinavian Boot Camp with the full name, address and contact details of the third party. Scandinavian Boot Camp will advise the Client in writing whether it consents to the assignment as soon as is reasonably practicable. Scandinavian Boot Camp reserves the right to refuse an assignment to a third party at any time without reason. If subsequently a Client has to cancel their Contract because Scandinavian Boot Camp refused to assign the Contract to a third party then the cancellation charges as per clause 9.1 shall apply.
10.2 Scandinavian Boot Camp may assign or sub-contract to any third party the performance of any of its obligations under the Contract without the consent of the Client.
11.1 If there is a problem during the course of a boot camp, the Client should report this to their boot camp coach. If the problem remains unresolved the Client should tell the Course Director.
11.2 In the unlikely event that the problem cannot be resolved at that time and the Client wishes to raise a complaint, full written details should be sent to Scandinavian Boot Camp at the registered address within 28 days of the end of the boot camp in question. The Client should include their booking reference number, full details of the complaint, and their daytime and evening telephone numbers. Failure to take these steps may prejudice Scandinavian Boot Camp’s ability to resolve the problem and/or investigate it fully.
12.1 None of the exclusions or limitations in these Terms and Conditions are intended to limit rights that the Client has under statute or common law; nor in any way are they intended to exclude or limit Scandinavian Boot Camp’s liability to its Clients for personal injury or death resulting from the negligence of Scandinavian Boot Camp or its contractors or agents; nor are they intended to exclude or limit any liability incurred as a result of fraud or fraudulent misrepresentation by Scandinavian Boot Camp.
12.2 The Client understands that taking part in Scandinavian Boot Camp involves some level of risk including, but not limited to, physical injury or even death. By attending Scandinavian Boot Camp the Client agrees to assume these risks and to release and discharge Scandinavian Boot Camp and its partners, management, contractors and agents from any and all claims for liability. Unless due to the negligence or other failure of Scandinavian Boot Camp to perform its obligations under this agreement or under the general law, Scandinavian Boot Camp will not be liable to the Client for the injury or death of the Client or any loss or damage to the Client’s property.
12.3 Neither Scandinavian Boot Camp nor any of its partners, management, contractors or agents will be liable for any loss or damage to any personal property or vehicle belonging to the Client during the boot camp.
Photographs and recordings
13.1 Scandinavian Boot Camp reserves the right to take photographs and/or recordings of Clients during the boot camp and the Client accepts that all rights whatsoever arising in these shall be owned solely by Scandinavian Boot Camp. The Client accepts and agrees that these may be used by Scandinavian Boot Camp on its website and in its literature for the purposes of promoting and advertising Scandinavian Boot Camp.
14.1 All literature and course material produced by Scandinavian Boot Camp including, but not limited to, websites, forms, images and graphics are the sole property of Scandinavian Boot Camp and may not be copied or duplicated for personal or commercial use. Scandinavian Boot Camp reserves all copyrights.
Law and Jurisdiction
15.1 These terms and conditions shall be governed by and construed in accordance with the law of United Kingdom.
15.2 A person who is not a party to this agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this agreement.
